How long do I have to file an appeal?

Criminal appellants must file a written Notice of Appeal within 14 days of their trial judgment – per the Federal Rules of Appellate Procedure Rule 4(b).

How do I know whether to appeal my conviction or sentence?

Knowing whether to appeal a federal conviction or sentence is not always clear. Your first move should be to get in contact with an experienced federal appellate attorney to examine your case and help you decide if you should challenge the outcome.

What happens if my conviction or sentence is affirmed?

If the Circuit Court of Appeals upholds your sentence or conviction, the next move may involve pursuing the appeal with the U.S. Supreme Court. The Supreme Court only hears a limited number of cases each year. You will need an experienced federal appellate team – familiar with the Supreme Court’s rules, procedures, and priorities – to create a request and present it effectively.

Can I represent myself in a deferral criminal appeal?

You can always represent yourself in court, but we strongly recommend against it. There are many, many complexities involved in the appeals process – and DOJ lawyers working to defend against your appeal. Working with an experienced federal appellate team is your best choice to achieve the desired result.
